Article 1. General Terms and Conditions
These General Terms and Conditions apply to all agreements and transactions entered into between BIG PANDA SPRL (hereinafter referred to as “Big Panda”) and the customer, notwithstanding any conflicting provisions or conditions that may be stipulated by the customer. Any order placed by the customer implies full and unconditional acceptance of these General Terms and Conditions. All contracts and transactions shall be governed by and interpreted in accordance with Belgian law, and any dispute shall fall under the exclusive jurisdiction of the Belgian courts. Nevertheless, in the event of a dispute, Big Panda will first seek to resolve the matter amicably.
Article 2. Prices
All prices are stated in euros and are exclusive of taxes (VAT excluded). All prices are subject to change. In the event of a price increase, an updated price list will be sent to customers and will be available at any time upon simple request by email.
Article 3. Transport Costs
Since the beginning of 2026, Big Panda has revised its transport cost policy for B2B orders.
Free transport from €1,500 excl. VAT
For any order delivered in mainland France or Europe with a total value equal to or exceeding €1,500 excl. VAT, transport costs are fully covered by Big Panda.
This free transport policy does not apply to :
- insular territories (Corsica, Sardinia, Balearic Islands, etc.)
- EFTA countries (Switzerland, Norway, Iceland, Liechtenstein)
Orders below €1,500 excl. VAT
For any order with a total value below €1,500 excl. VAT, a flat-rate transport fee applies depending on the delivery area :
Mainland France (excluding Corsica)
- €60 excl. VAT / pallet
- €30 excl. VAT / carton (maximum weight: 30 kg)
70% compensation granted in the form of free goods
Europe (excluding insular territories)
- €80 excl. VAT / pallet
- €30 excl. VAT / carton (maximum weight: 30 kg)
70% compensation granted in the form of free goods
Rest of the world & insular territories
- Transport costs calculated based on volume and weight (quotation required)
70% compensation granted in the form of free goods
Compensation
Big Panda undertakes to contribute to transport costs through the addition of free goods to the order. The compensation granted by Big Panda covers up to 70% of the transport costs and is calculated based on the recommended retail price of the goods. However, this compensation does not constitute an obligation for Big Panda and is granted at its sole discretion.
Article 4. Orders
Once the invoice has been issued and the goods dispatched, the order becomes irrevocably binding on the customer.
Article 5. Shipments
All goods are shipped via GLS, France Express, or Schenker. Upon receipt of the goods, the customer’s signature to the carrier constitutes acceptance of the goods as delivered. The customer is therefore required to check the overall condition of the goods prior to signing. Any damage incurred during transport cannot be claimed from Big Panda once the delivery note has been signed without reservation.
Article 6. Payment Terms
The first order must be paid in advance via a pro forma invoice. From the second invoice onwards, payment must be made within 30 days from the invoice date.
Article 7. Late Payment
If payment is not received within 30 days from the invoice date, a first reminder will be sent by email. A second reminder will be sent if payment is still outstanding. If payment is not made after these two email reminders, a registered letter will be sent to the customer. Failure to pay following this registered notice will automatically result in the application of late payment interest, in accordance with the Belgian Law of 2 August 2002 on combating late payment in commercial transactions (transposing Directive 2000/35/EC of the European Parliament and of the Council of 29 June 2000).
The applicable legal interest rate shall be determined according to the latest notice published in the Belgian Official Gazette. For the first half of 2026, the applicable rate is 10.5%. These interest charges shall also be increased by any applicable legal reminder and procedural costs.
Article 8. Method of Payment
Payments are accepted exclusively by bank transfer. Cheques are not accepted.
Article 9. Craftsmanship
Most of our products are handcrafted and hand-painted. As a result, minor defects or imperfections may occur. Such minor defects or imperfections cannot, under any circumstances, constitute valid grounds for a claim.
Article 10. Claims – After-Sales Service
Any claims regarding a product (e.g. missing or damaged items) or an invoice must be submitted by email to info@bigpanda.be within 3 days of receipt of the goods. After this period, the invoice shall be deemed definitively accepted by the customer. In the event of defective products, the goods will be credited once they have been received back at Big Panda’s premises. The customer undertakes to carefully package the defective goods and to provide Big Panda with the dimensions and weight of the carton or pallet so that transport can be arranged under optimal conditions.
